Amazon - Seller refuses refund

Junior ReviewerI purchased on Dec 12th a birhouse to mount on a 4 x 4, the birdhouse is nice, but the copper-roof had some deep visible sratches, for the price I did not want to keep it and sent it back on Dec 17th, I requested refund, this is what I got from the seller:

Hi, I just saw your review. I think there's an issue with Amazon.
I received a cancellation request 12/20 so I cancelled the order and Amazon should have refunded you your money.
I don't have any access to your account. If you don't receive your refund in the next couple of days I would contact them.

I chatted with Amazon, Amazon is not responsible for the refund, because NC Birdguy is a 3rh party seller.
Amazon is now investigating and maybe will refund me via the A-Z-guarantee-program.
I am wondering how often NC Birdguy is handling a return this way, til Amazon pulls the rip cord !!
